§ 9-10. Use of wireless communication devices in a designated school crossing zone

  • (a) Definitions. For the purposes of this section, the following words, terms and phrases shall have the meaning subscribed thereto, unless the context of their usage clearly indicates otherwise.

    City shall mean the City of El Lago, Texas, a general law municipal corporation of the State of Texas.

    City council shall mean the governing body of the city.

    Designated school crossing zone shall mean a reduced-speed zone designated on a street by the city to facilitate safe crossing of the street by children going to or leaving a public or private elementary or secondary school during the time the reduced speed limit applies.

    Hands-free device means speakerphone capability or a telephone attachment or other piece of equipment, regardless of whether permanently installed in the motor vehicle, that allows use of the wireless communication device without use of either of the operator's hands.

    Wireless communication device means a device that uses a commercial mobile service, as defined by 47 U.S.C. § 332.

    (b) Prohibition. An operator of a motor vehicle may not use a wireless communication device while operating a motor vehicle within a designated school crossing zone unless:

    (1) The motor vehicle is stopped; or

    (2) The wireless communication device is used with a hands-free device.

    (c) Posting of signs. The city council directs the Lakeview Police Department to post a sign or signs that comply with the standards established by the department of transportation at the entrance to each designated school crossing zone in the city so that the city might enforce the terms of this section under the laws of the State of Texas.

    (d) Penalty. Any person who has violated this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed two hundred dollars ($200.00).
